Farm Owners Will Be Held to a Higher Standard for Recruiting Foreign Workers

H-2A farmworkersThe Wall Street Journal (WSJ) reported that beginning March 15, 2010, employers seeking H-2A farm worker visas for foreign national workers will now be required to provide documented evidence of their recruitment efforts to show that they have tried to find qualified U.S. workers as opposed to merely filing an attestation concerning recruitment.

In light of the new rules, the U.S. Department of Labor  (USDOL) has also created a national electronic job registry to help farm owners find American workers.

As part of the crackdown on undocumented workers, the government is implementing these measures to uphold the integrity of the system and, to ensure that qualified Americans can be employed light of the rising unemployment rate.
