The Orlando Sentinel reported today that a 23 year old college student from Egypt who was acquitted last month on federal explosives charges, is now in deportation proceedings. An immigration judge will determine whether or not he should be deported.
A Tampa jury found Youssef Megahed not guilty of possessing explosives that could have been used to make a destructive device.
Mr. Megahed was apprehended and jailed by the U.S. Immigration & Customs Enforcement (USICE) three days after his acquittal.
Before an immigration judge can determine whether an alien should be deported, the Trial Attorney (TA)representing the USICE must establish by clear and convincing evidence that the allegations on the Notice to Appear (the charging document issued by the USICE that begins a deportation proceeding) are true and correct. Additionally, the TA must also prove that an alien is deportable based on the allegations for which an immigration judge has the authority to sustain or dismiss the charge.
